Are you behind on your bills? Are you facing foreclosure? Are you being harassed by creditors? If you answered yes to any of those questions, you may need to consider filing for bankruptcy. Dale Montgomery has spent over 25 years providing expert legal guidance. It’s time to let him put his experience to work for you.
You are allowed to file your own bankruptcy case, but doing so without an experienced lawyer can be very complicated. Additionally, you must receive the required credit counseling from an approved non-profit agency prior to filing.
Different Types of Bankruptcy
- Chapter 7 – Chapter 7 bankruptcy is a “liquidation” bankruptcy, in which a person known as a Trustee is appointed to determine if you have any property that is not exempt or protected by the law. If you own such a property, the Trustee is to take the property, sell it, and use the proceeds
to pay your creditors. Due to laws in Texas, most people do not end up losing property to
the Trustee.
At the end of the bankruptcy, usually 5-6 months after filing, you will receive an order from the court called a “discharge.” This order means you will no longer legally owe debts, which were discharged. Creditors are prohibited by law from attempting to sue you or otherwise attempt to collect the debts. However, some debts cannot be discharged under Chapter 7.
- Chapter 13 – Chapter 13 bankruptcy allows you to discharge some types of debt that are not dischargeable under Chapter 7. Under Chapter 13, you are able to pay off a mortgage and / or income taxes over an extended period of time without incurring new interest or penalties.
